General rental conditions

These terms and conditions apply to all bike rentals organized by Vanelo Concept Srl, each rental being subject to a rental contract with the renter,

The lessor, hereinafter referred to as "VC": Vanelo Concept SRL - Head office: 53a, Chaussée de la Hulpe 1180 Brussels - Shop: 143 Rue Américaine - 1050 Ixelles, +32 475 79 56 35
The lessee, hereinafter referred to as "LOC": the person who, on the basis of the details in the rental contract, rents a bicycle from the lessor "VC".

ARTICLE I.
VC reserves the right to assess the ability and aptitude of participants to use a bicycle as part of its rental service. LOC declares that he/she is fit to ride a bicycle and has no medical contraindications.

ARTICLE II.
The rented equipment (bicycle and accessories) remains the exclusive property of VC for the duration of the rental period. The renter may not lend or sublet the equipment to a third party without VC's consent.

ARTICLE III.
Before concluding the rental contract with the Hirer, VC will require the Hirer to identify himself/herself by presenting one or more valid identification documents (ID card, driving license, etc.) as well as the Hirer's cell phone number; VC will indicate the corresponding information on the rental contract and will take a digital photo of the identification document used by the Hirer.

ARTICLE IV.
The RENT acknowledges that he/she has taken out personal liability insurance covering his/her liability for the use of the said bicycle with regard to both himself/herself and third parties.

ARTICLE V.
The lessee acknowledges that the rented bicycle is in perfect working order and undertakes to use it with care, to provide for its maintenance, to return it at the end of the rental period in the condition in which it was at the time of receipt, and to hand it over to the lessor on the dates and at the location stipulated in the contract. The condition, size and model of the rented bicycles are known to the LOC.

ARTICLE VI.
VC reserves the right to charge the RENTER for any damage to the bicycle during the rental period by keeping the security deposit and invoicing any additional damage costs, which the RENTER hereby accepts (see article VI).

ARTICLE VII.
If the rental period initially agreed is exceeded, a surcharge based on the hourly rate will be applied. The total surcharge will be deducted from the security deposit.

ARTICLE VIII.
If the bike is lost, stolen or damaged, VC reserves the right to claim compensation of €4,000 for Riese & Muller, Victoria and I:SY bikes, €4,300 for Balance Van Raam bikes, €6,500 for GSD Tern bikes and between €7,500 and €11,000 for Urban Arrow, adapted Van Raam or Seniors bikes, without prejudice to the retention of the security deposit.

ARTICLE IX.
The LOC undertakes to report any loss or theft of the bicycle or its accessories to the VC rental company and to the police authorities within 24 hours.

ARTICLE X.
If the LOC contravenes the laws and regulations in force during the rental period, VC cannot under any circumstances be held responsible. Cyclists ride under their own responsibility and undertake to comply with the Highway Code. The LOC is therefore responsible for any damage caused by the carelessness of the driver/user of the bicycles.

ARTICLE XI.
Bicycle rentals are payable in advance.
On site, the LOC hirer provides proof of identity. VC reserves the right to request a deposit of between €300 and €750 in cash or by electronic deposit for each electric bike rented.
The security deposit will be returned once the inspection of the rented bike and equipment has been completed and subject to art. VI, VII, VIII.

ARTICLE XII.
In the event of any breakdown or incident, the LOC may contact VC by telephone.
The LOC cannot undertake any repair work and is obliged to return the bike to the point of departure. Under no circumstances may the renter claim for damages during the rental period.

ARTICLE XIII.
The rental contract does not include any insurance; the LOC is responsible for any damage caused to the bicycles, which are not insured against liability or damage in the event of an accident. Theft and loss of equipment are not covered. In such cases, the equipment will be invoiced to the LOC on the basis of its value.

ARTICLE XIV.
In the event of cancellation:
- more than 7 days before the rental date and time, VC will refund 50% of the rental price.
- less than 7 days before the rental date and time, LOC will be billed for the full rental price.

ARTICLE XV.
All rented equipment must be returned at the time and on the day stipulated in the contract. In the event of late return, VC will invoice LOC for each 24-hour period at the daily rental rate.
